GoPro Files Patent Infringement Complaint Against Insta360 Seeks Section 337 Investigation

GoPro accuses Insta 360 of patent infringement requesting a Section 337 investigation to halt the import and sale of products in the US.

On April 2, 2024, GoPro, a renowned American technology company, lodged a formal complaint under Section 337 of the United States Tariff Act of 1930, alleging that certain cameras, camera systems, and their accompanying accessories imported, sold, or exported to the US by Insta360, a Chinese firm based in Shenzhen, infringe upon GoPro’s patents.

The complaint, which involves both Chinese and American companies, was submitted to the United States International Trade Commission (USITC), marking a significant move in the tech industry’s intellectual property rights battles.

The dispute centers on a range of Insta360’s consumer-grade products, including models like the ONE X, ONE R, ONE R1-inch, ONE X2, ONE RS, ONE RS 1-inch 360, X3, GO3, Ace, and ACE Pro.

GoPro’s filing details evidence of these products being imported into the US, alongside comparative evidence of infringement, essentially encompassing nearly all of Insta360’s offerings in the consumer market.

The 337 investigation, also known as an “unfair import” probe, is initiated by the USITC under the provisions of the Tariff Act of 1930 and its amendments. It aims to address and mitigate unfair practices in import trade, specifically those that infringe on American intellectual property rights or constitute other forms of unfair competition.

Through this legal mechanism, GoPro seeks to obtain a limited exclusion order and a cease and desist order against Insta360, effectively attempting to bar the importation and sale of the alleged infringing products in the United States.

As of the time of reporting, Insta360 had not issued a response to the allegations. The tech community and stakeholders in the global trade and patent landscapes are closely monitoring this case, as its outcome could have far-reaching implications for international trade practices and the enforcement of intellectual property rights across borders.
